These Terms & Conditions govern your use of the In-Tune mobile application, developed and published by Jazagora. By installing or using In-Tune, you agree to these terms. Mandatory consumer rights under applicable law remain unaffected.
1. Purpose of the app
In-Tune is a chromatic tuner and audio tone generator intended to assist musicians with pitch recognition, tuning, waveform selection, and musical practice.
2. Licence
Jazagora grants you a limited, non-exclusive, non-transferable, revocable licence to use In-Tune for personal or professional musical purposes on devices that you own or control, subject to applicable app-store terms.
3. Acceptable use
You may not reverse engineer, redistribute, resell, modify, or exploit In-Tune except where such restriction is prohibited by applicable law. You may not use the app in a way that infringes intellectual-property rights, disrupts devices or services, or violates applicable law.
4. Tuning accuracy
Pitch detection can be affected by microphone quality, device processing, background noise, harmonics, instrument attack, distance, and room acoustics. In-Tune is a practical musical aid and is not certified laboratory, medical, safety, or industrial measurement equipment. You remain responsible for verifying critical measurements with appropriate equipment.
5. Tone-generator safety
Generated tones may become uncomfortable or harmful at excessive volume, particularly through headphones or at high frequencies. Start at a low volume, increase gradually, and stop playback if you experience discomfort. You are responsible for setting a safe listening level and for protecting nearby people and animals from excessive sound.
6. Microphone permission
Live tuning requires microphone access. You may deny or withdraw this permission through Android settings, but the live tuner will not function without it. Microphone handling is described in the In-Tune Privacy Policy.
7. Availability and changes
We may update, improve, suspend, or discontinue features when reasonably necessary for security, compatibility, legal compliance, or product development. We do not guarantee uninterrupted availability on every device or future Android version.
8. Intellectual property
In-Tune, its original software, interface, graphics, branding, and documentation are owned by Jazagora or its licensors and are protected by applicable intellectual-property laws. Third-party names and trademarks remain the property of their respective owners.
9. Disclaimer and liability
To the maximum extent permitted by applicable law, In-Tune is provided on an “as available” basis. Jazagora is not liable for indirect or consequential losses arising from device incompatibility, inaccurate readings caused by environmental or hardware limitations, misuse of the tone generator, or failure to follow safe listening practices. Nothing in these terms excludes liability that cannot legally be excluded.
10. External links
In-Tune may open Jazagora legal and support pages in your browser. External platforms, including Google Play and device services, operate under their own terms and policies.
11. Governing law
These terms are governed by Italian law, without limiting any mandatory protections available to consumers in their country of residence. Where mandatory law permits a choice of forum, disputes will be handled by the competent courts identified under applicable Italian law.
